Komisijas imunitāte pret saukšanu pie atbildības Viss Komisijas īpašums un aktīvi neatkarīgi no to atrašanās vietas ir imūni pret jebkuru kratīšanu, arestu, rekvizīciju, apķīlāšanu, konfiskāciju, ekspropriāciju, aizturēšanu vai soda uzlikšanu, neatkarīgi no izpildu varas, administratīvās vai tiesu darbības, izņemot attiecībā uz: a) civilprasību par kaitējumu, kas radies no automašīnas vai cita transporta līdzekļa, kas pieder Komisijai vai ko lieto Komisijas uzdevumā, izraisītā nelaimes gadījumā, vai attiecībā uz satiksmes pārkāpumu, iesaistot minētos transporta līdzekļus; b) pretprasību, kas tieši saistīta ar tiesas procesu, ko ierosinājusi Komisija.
  1. a)) "Helsinki Convention" means the Convention on the Protection of the Marine Environment of the Baltic Sea Area, 1974 or the Convention on the Protection of the Marine Environment of the Baltic Sea Area, 1992, whichever is in force;
  2. a)) civilprasību par kaitējumu, kas radies no automašīnas vai cita transporta līdzekļa, kas pieder Komisijai vai ko lieto Komisijas uzdevumā, izraisītā nelaimes gadījumā, vai attiecībā uz satiksmes pārkāpumu, iesaistot minētos transporta līdzekļus;
  3. b)) pretprasību, kas tieši saistīta ar tiesas procesu, ko ierosinājusi Komisija.
  4. b)) "Commission" means the Baltic Marine Environment Protection Commission in Helsinki established pursuant to the Helsinki Convention;
  5. c)) "Party to the Helsinki Convention" means a Contracting Party to the Helsinki Convention;
  6. d)) "Host Agreement" means the Agreement between the Government of Finland and the Baltic Marine Environment Protection Commission on the Office and the Privileges and Immunities of the Commission;
  7. e)) "Representatives" means representatives of the Parties to the Helsinki Convention and in each case means heads of delegations and members of the delegations;
  8. f)) "Staff Member" means the Executive Secretary and any person employed permanently by the Commission and subject to its staff regulations and stationed in Finland;
  9. g)) "Expert on mission" means a person other than a staff member appointed to carry out a specific task for or on behalf of the Commission;
  10. h)) "Official functions" means activities carried out by the Commission in pursuance of its purpose as defined in the Helsinki Convention and includes its administrative activities;
  11. i)) "Archives" include all manuscripts, correspondence, documents, photographs, films, optical and magnetic recordings, data recordings, graphic presentations and computer programmes, belonging to or held by the Commission;
  12. j)) "Property" means anything that can be the subject of a right of ownership, including contractual rights and movable and immovable property.
  13. a)) a civil action for damage arising from an accident caused by a motor vehicle or other means of transport belonging to, or operated on behalf of the Commission, or in respect of a traffic offence involving such means of transport;
  14. b)) a counter-claim directly connected with judicial proceedings initiated by the Commission.
  15. a)) immunity from personal arrest or detention and from seizure of personal luggage;
  16. b)) immunity from legal process in respect of words spoken or written or acts done in the performance of official functions for the Commission;
  17. c)) inviolability of all papers and documents relating to the work for which he or she is engaged by the Commission;
  18. d)) facilities in respect of currency or exchange regulations as necessary for the effective exercise of his or her functions.
  19. a)) immunity from any form of arrest or detention pending trial;
  20. b)) immunity from legal process, even after the termination of their mission, in respect of acts, including words spoken or written, done by them in the exercise of their official functions; however, there shall be no immunity in the case of a traffic offence committed by a representative, or in the case of damage caused by a motor vehicle or other means of transport belonging to or driven by him or her;
  21. c)) inviolability of all their official papers;
  22. d)) the same facilities in respect of currency and exchange control as is accorded to diplomatic agents of foreign states on temporary official missions;
  23. e)) the same facilities in respect of customs as regards their personal luggage as is accorded to diplomatic agents of foreign states on temporary official missions.
  24. a)) immunity from any form of arrest or detention pending trial;

  29. a)) the Parties in respect of their representatives;
  30. b)) the Commission in respect of the Executive Secretary;
  31. c)) the Executive Secretary in respect of staff members and experts on mission;
  32. d)) the meeting of the Commission convened, if necessary in extraordinary session, in respect of the Commission.
  33. a)) notify all Parties and the Executive Secretary of the Commission of:
  34. b)) transmit certified copies of this Agreement to the Parties to the Helsinki Convention and to the Executive Secretary of the Commission.
