5. Article
1. Šo Līgumu var parakstīt Hartas Parakstītājas.
2. Šo Līgumu ratificē, apstiprina vai pieņem. Ratifikācijas,
apstiprināšanas vai pieņemšanas dokumentus iesniedz Ungārijas
Republikas valdībai.
3. Šim Līgumam var pievienoties visas Hartas Parakstītājas.
Pievienošanās dokumentus iesniedz Ungārijas Republikas
valdībai.
4. Šis Līgums stājas spēkā 30.dienā pēc trešā ratifikācijas,
apstiprināšanas vai pieņemšanas dokumenta iesniegšanas. Katrai
Hartas Parakstītājai, kas ratificē, apstiprina, pieņem vai
pievienojas Līgumam pēc trešā ratifikācijas, apstiprināšanas, vai
pieņemšanas dokumenta iesniegšanas, Līgums stājas spēkā 30.dienā
pēc šādas Hartas Parakstītājas ratifikācijas, apstiprināšanas,
pieņemšanas vai pievienošanās dokumenta iesniegšanas.

Agreement on
the Legal Status
of The
Regional Environmental Center for Central and Eastern
Europe
The
Parties to the present Agreement,
Considering that
The Regional Environmental Center for Central and Eastern Europe
(REC) was established in 1990 and was given the mission to assist
in addressing environmental issues mainly in Central and Eastern
Europe,
Referring to
the 1996 Charter of the REC (hereinafter referred to as "the
Charter"),
Recognizing that
the REC has developed over time into a de facto international organization pursuing an
international mandate, composed of a Head Office and a network of
country offices,
Referring to the
'Declaration of the Signatories to the Charter of The
Regional Environmental Center for Central and Eastern Europe on
the occasion of the 20th Anniversary of the foundation of the
REC' adopted on 18 June 2010, in which the Signatories
recommended "to pave the way for harmonization by concluding
a new, optional, multilateral instrument for interested
Signatories".
Convinced that it
is necessary to create the possibility for Signatories to the
Charter to become party to an agreement in which international
legal personality is explicitly given to the REC, without
changing the present function of the Charter as the basic
document for the functioning of the REC,
Have agreed as follows:
Article 1
1. The Parties hereby recognize that
the REC is an international organisation with a seat in
Szentendre, Hungary.
2. The Parties hereby recognize that
the REC has international legal personality. It shall also have
such legal capacity as may be necessary for the exercise of its
functions and the fulfillment of its purposes, including the
capacity to contract, to acquire and dispose of movable and
immovable property, and to institute and participate in legal
proceedings.
Article 2
The present Agreement shall not
affect the objectives, characteristics and institutional
structure of the REC as stated in the Charter and shall also not
affect the legal status of the REC for the Signatories to the
Charter that are not Parties to the present Agreement.
Article 3
The present Agreement shall not
affect the rights and obligations of the REC which may derive
from agreements or contractual arrangements it may have concluded
with any Government or third party.
Article 4
No Party to this Agreement, by
reason of any of its provisions, shall be liable for acts,
omissions, obligations or debts of the REC.
Article 5
1. The
present Agreement shall be open for signature by the Signatories
to the Charter.
2. The present Agreement shall be
subject to ratification, approval or acceptance. The instruments
of ratification, approval or acceptance shall be deposited with
the Government of the Republic of Hungary.
3. The present Agreement shall
remain open for accession by any Signatory to the Charter. The
instruments of accession shall be deposited with the Government
of the Republic of Hungary.
4. The present Agreement shall enter
into force on the thirtieth day following the day of deposit of
the third instrument of ratification, approval or acceptance. For
each Signatory to the Charter ratifying, approving, accepting or
acceding to the present Agreement after the deposit of the third
instrument of ratification, approval or acceptance, the Agreement
shall enter into force on the thirtieth day following the day of
deposit by such Signatory to the Charter of its instrument of
ratification, approval, acceptance, or accession.
