5. Article
1. Līgumslēdzējas Puses, ja to nacionālā likumdošana atļauj, var nolemt, ka pārrobežu sadarbības institūcija ir juridiska valsts persona, un ka, saskaņā ar katras Līgumslēdzējas Puses likumdošanas sistēmu, jebkurām darbībām, ko veic šī pārrobežu sadarbības institūcija, piešķirams tāds pats juridisks spēks un izpildvara kā tad, ja šīs darbības veiktu teritoriālās kopienas vai pārvaldes institūcijas, kas parakstījušas līgumu.
2. Tomēr līgumā var arī tikt norādīts, ka šādu darbību izpilde, it īpaši, ja šīs darbības skar iedzīvotāju tiesības, brīvības vai intereses, ir to teritoriālo kopienu vai pārvaldes institūciju pārziņā, kas parakstījušas līgumu. Turklāt katra Līgumslēdzēja Puse var norādīt, ka vispārējo pienākumu pildīšana neattiecas uz pārrobežu sadarbības institūciju, un ka šādai struktūrai netiek piešķirtas tiesības pieņemt vispārēja rakstura lēmumus.
- a)) any signature;
- b)) any deposit of an instrument of ratification, acceptance, approval or accession;
- c)) any date of entry into force of this Convention in accordance with Article 9 thereof;
- d)) any declaration received in pursuance of the provisions of paragraph 2 of Article 2 or of paragraph 5 of Article 3;
- e)) any notification received in pursuance of the provisions of Article 11 and the date on which denunciation takes effect.
- a)) Within the framework of current laws and regulations, the Parties undertake to institute and develop a procedure for mutual consultation to precede the stage of planning preparation in the field of spatial development and, where appropriate, of regional development.
- b)) They shall endeavour to co-ordinate objectives and to work out joint policies in the field of spatial planning with regard to the development of their respective territories.
- c)) The Parties undertake to put in hand the measures necessary for implementing the projects co-ordinated by the competent [national] [regional] [local] authorities.
- a)) action by the transfrontier co-operation body shall be governed by its statute and by the law of the headquarters State;
- b)) the transfrontier co-operation body shall not, however, be empowered to take measures which apply generally or which might affect the rights and freedoms of individuals;
- c)) the transfrontier co-operation body shall be financed from the budgets of the territorial communities or authorities. It shall not be empowered to impose levies of a fiscal nature. It may, where appropriate, receive revenue in respect of services provided by it to territorial communities or authorities, users or third parties;
- d)) the transfrontier co-operation body shall have an annual estimated budget and shall draw up a balance-account which shall be approved by auditors independent of the territorial communities or authorities party to the agreement.
- a)) signature without reservation as to ratification, acceptance or approval; or
- b)) signature subject to ratification, acceptance or approval, followed by ratification, acceptance or approval.
- a)) any declarations submitted by the Contracting Parties in conformity with Article 8;
- b)) any signature;
- c)) the deposit of any instrument of ratification, acceptance, approval or accession;
- d)) any date of entry into force of this Protocol, in accordance with Articles 11 and 12;
- e)) any other measure, notification or communication relating to this Protocol.
