4. Article

AVIOKOMPĀNIJAS NOZĪMĒŠANA UN PILNVAROŠANA 1. Lai veiktu Nolīgumā paredzēto satiksmi noteiktajos maršrutos, katrai Līgumslēdzējai Pusei ir tiesības rakstiski nozīmēt otrai Līgumslēdzējai Pusei vienu vai vairākas aviokompānijas. 2. Katrai Līgumslēdzējai Pusei ir tiesības atsaukt vai grozīt šo nozīmējumu. 3. Saņemot šādu rakstisku nozīmējumu, otras Līgumslēdzējas Puses aviācijas institūcijas saskaņā ar šā panta 4.punktu un 5.panta 1.punktu nekavējoties izsniedz katrai nozīmētajai aviokompānijai attiecīgu pārvadājumu atļauju. 4. Vienas Līgumslēdzējas Puses aviācijas institūcijas ir tiesīgas pieprasīt, lai otras Līgumslēdzējas Puses nozīmētā aviokompānija pierāda, ka tā spēj pildīt likumus un noteikumus, kurus saskaņā ar Konvencijas prasībām šīs institūcijas parasti un saprātīgi piemēro starptautiskajiem gaisa pārvadājumiem. 5. Pēc nozīmēšanas un pilnvarošanas aviokompānija, ja tā ir izpildījusi visus šā Nolīguma noteikumus, to skaitā noteikumus, kas attiecas uz tarifiem, jebkurā laikā drīkst uzsākt Nolīgumā paredzēto satiksmi.
  1. a)) the term "Chicago Convention" means the Convention on International Civil Aviation opened for signature at Chicago on 7 December 1944, and includes any Annex adopted under Article 90 of that Convention and any amendment of the Annexes and Convention adopted under Articles 90 and 94 thereof so far as those Annexes and amendments have been adopted by both Contracting Parties;
  2. b)) the term "aeronautical authorities" means, in the case of the Republic of Latvia, the Ministry of Transport, and in the case of the Slovak Republic, the Ministry of Transport, Posts and Telecommunications — Department of Civil Aviation, or, in both cases, any other person or body authorized to perform any functions at present exercised by the said aeronautical authorities;
  3. c)) the term "designated airline" means an airline which has been designated and authorized in accordance with Article 4 of this Agreement;
  4. d)) the terms "territory", "air service", "international air service", "airline" and "stop for non-traffic purposes" have the meanings respectively assigned to them in Articles 2 and 96 of the Chicago Convention;
  5. e)) the term "Annex" means the Annex to this Agreement or as amended in accordance with the provisions of paragraph 2 of Article 19 of this Agreement;
  6. f)) the term "agreed services" means scheduled air services on the routes specified in the Annex to this Agreement for the carriage of passengers, cargo and mail, separately or in combination;
  7. g)) the term "tariff" means the prices to be charged for the carriage of passengers, baggage or cargo (excluding mail), including any significant additional benefits to be furnished or made available in conjunction with such carriage, and the commission to be paid on the sales of tickets for the carriage of persons, or on corresponding transactions for the carriage of cargo. It includes also the conditions that govern the applicability of the price for carriage or the payment of commission.
  8. a)) the right to fly across its territory without landing;
  9. b)) the right to make stops in its territory for non-traffic purposes.
  10. a)) in any case when the designated airline can not prove that substantial ownership and effective control of that airline are vested in the Contracting Party designating the airline or in its nationals; or
  11. b)) in case of failure by that airline to comply with the laws and/or regulations of the Contracting Party granting the rights; or
  12. c)) in case the airline otherwise fails to operate in accordance with the conditions prescribed under this Agreement.
  13. a)) aircraft stores taken on board in the territory of one Contracting Party within reasonable limits, for use on an outbound aircraft engaged in an international air service of a designated airline of the other Contracting Party;
  14. b)) spare parts, including engines, introduced into the territory of one Contracting Party for the maintenance or repair of aircraft engaged in an international air service of a designated airline of the other Contracting Party;
  15. c)) fuel, lubricants and consumable technical supplies introduced into or supplied in the territory of one Contracting Party for use in an international air service of a designated airline of the other Contracting Party, even when these supplies are to be used on the part of the journey performed over the territory of the other Contracting Party, in which territory they are taken on board.
  16. a)) the traffic requirements between the country of origin and the countries of ultimate destination of the traffic;
  17. b)) the requirements of through airline operations; and
  18. c)) the traffic requirements of the area through which the airline passes, after taking account of local and regional services.
